Diminished value claims with Allstate

Three appellate decisions in our research involve Allstate and diminished value. An Illinois court held in 2006 that the collision policy before it did not cover it. A federal appeals court held in 2024 that an express exclusion in Allstate’s uninsured motorist coverage was valid under Mississippi law. A 2002 Wisconsin case involved a claim against a driver Allstate insured.

Whose policy the claim is on

Two of the three cases were brought by Allstate policyholders under their own coverage. The third was brought by people whose car was hit by a driver Allstate insured. The difference decides which rules apply to you, and it is explained in first-party vs third-party diminished value. Autoloss is independent. It is not affiliated with or endorsed by Allstate, and the company’s name is used only to identify it.

Illinois: Sims v. Allstate (2006)

Policyholders brought a class action saying Allstate had paid for repairs but not for the repaired vehicles’ diminished value. The trial court found the policy ambiguous and sent the case to a jury, which returned a verdict for Allstate. On appeal, the Illinois Appellate Court, Fifth District, affirmed on a different ground. It held that the policy, which capped liability at what it would cost “to repair or replace the property or part with other of like kind and quality,” was unambiguous and did not require compensation for a repaired vehicle’s loss in market value. One justice dissented and would have found the policy ambiguous. See the Illinois page.

Mississippi: Watkins v. Allstate (5th Cir. 2024)

After the at-fault driver’s insurer paid for the repair, a policyholder claimed diminished value under his own uninsured motorist coverage. The policy said Allstate would not pay for “any decrease in the property’s value, however measured, resulting from the loss and/or repair or replacement.” The policyholder did not dispute what the wording meant; he argued it was against Mississippi public policy. The U.S. Court of Appeals for the Fifth Circuit held the exclusion valid under Mississippi law. It is a federal court’s reading of Mississippi law on one policy form. See the Mississippi page.

The practical point is narrow: if you are claiming on your own policy, look for wording of this kind before anything else.

Wisconsin: Paulson v. Allstate (2002)

Here Allstate was the liability insurer of the driver who struck the plaintiffs’ car. The Wisconsin Court of Appeals decision mainly concerns sanctions, subrogation and costs. In passing, the court noted that the parties agreed the plaintiffs could recover the reasonable cost of repairs or the diminution in the vehicle’s fair market value, whichever was less. It did not rule on a claim for loss of value remaining after repair. Wisconsin law on that point is covered on the Wisconsin page.

How to submit a claim to Allstate

Allstate’s “File or Track a Claim” page was the company’s published starting point for claims when we checked in October 2026. If the property damage claim is already open, write to the adjuster named on your paperwork and quote the claim number. How to contact an auto insurer about a claim explains how to confirm the contact. Send the demand, the appraisal and the final repair invoice together; the demand letter guide has the checklist.

The role of an appraisal

An appraisal does not change what a policy covers. Where a claim is open to you, it supplies the amount and the reasoning behind it. An Autoloss diminished value appraisal is prepared from your repair order, photos and records, costs $250–$350 in a typical case, and includes a custom demand letter.

If there is no agreement

After your appraisal lists the routes open to you, and how to file an auto insurance complaint explains what a state insurance department can and cannot do. The steps common to every company are in the general filing guide. The American Family guide discusses a Wisconsin policy decision that sits alongside Paulson.

Common questions

Does my Allstate policy cover diminished value?

It depends on the policy wording and your state. In Sims (Ill. App. Ct. 2006) and Watkins (5th Cir. 2024), courts held that the Allstate policy provisions before them did not provide it. Read your own policy, including any exclusion that mentions a decrease in value.

What if an Allstate policyholder was at fault?

Then you are a third-party claimant, and your state’s law on property damage applies rather than the policy rulings above. Check the page for your state.

Is Autoloss affiliated with Allstate?

No. Autoloss is independent and is not affiliated with or endorsed by Allstate. The name is used only to identify the insurer.
