Hawaii small claims court for diminished value claims
In Hawaii, small claims cases are heard in District Court, Small Claims Division, which handles claims up to $5,000. If an insurer will not pay a diminished value claim and the amount is within the limit, this is where an owner can sue the at-fault driver. You bring the evidence, and the judge decides.

How small claims court works in Hawaii
- Claim limit
- $5,000. Money claims of no more than $5,000, not counting interest and costs. The Judiciary says a counterclaim may ask for up to $40,000, and larger claims go to the Regular Claims Division of the District Court. Haw. Rev. Stat. § 633-27(a)(1).
- Where to file
- File in the small claims division of the district court for the judicial circuit where the defendant (or most of the defendants) lives or where the claim arose.
- Attorneys
- Attorneys may appear in ordinary money claims; they are barred only in residential security deposit cases, and with the court's approval a non-lawyer may appear for a party without pay (§ 633-28(b)).
- Filing fee
- Set by the court and often by county. Check the court’s fee schedule before you file.
- Appeals
- There is no appeal from a small claims judgment; the court may alter or set aside its own judgment as its rules allow.
Who you sue
Ask the District Court, Small Claims Division clerk how to name the defendant. In most states that is the at-fault driver, not the insurance company.
