Illinois small claims court for diminished value claims
In Illinois, small claims cases are heard in Circuit Court (small claims), which handles claims up to $10,000. If an insurer will not pay a diminished value claim and the amount is within the limit, this is where an owner can sue the at-fault driver. You bring the evidence, and the judge decides.

How small claims court works in Illinois
- Claim limit
- $10,000. A small claim is a tort or contract action for money of not more than $10,000, not counting interest and costs. The $10,000 figure has applied to cases filed since January 1, 2006. Ill. S. Ct. R. 281.
- Where to file
- File in the county where a defendant lives or the county where the accident or transaction, or some part of it, took place (735 ILCS 5/2-101).
- Attorneys
- Individuals may appear with or without a lawyer; a corporation must have a lawyer to bring a small claim but may defend one through an officer, director or manager (Ill. S. Ct. R. 282(b)).
- Filing fee
- Set by the court and often by county. Check the court’s fee schedule before you file.
- Appeals
- A small claims judgment is a final circuit court judgment, so either side may appeal as of right by filing a notice of appeal (Ill. S. Ct. R. 301); the appeal is a review of the case, not a new trial.

Who you sue
Ask the Circuit Court (small claims) clerk how to name the defendant. In most states that is the at-fault driver, not the insurance company.
