Maine small claims court for diminished value claims
In Maine, small claims cases are heard in District Court (small claims), which handles claims up to $10,000. If an insurer will not pay a diminished value claim and the amount is within the limit, this is where an owner can sue the at-fault driver. You bring the evidence, and the judge decides.

- Claim limit
- $10,000. The limit is $10,000 as of January 1, 2026, not counting interest and costs (raised by P.L. 2025, c. 261). A larger claim can be filed in small claims, but the judgment is capped at $10,000 and the rest is given up. 14 M.R.S. § 7482.
- Where to file
- File in the District Court where the events happened, or where the defendant lives or has its main place of business (or, for a business entity, where its registered agent is located).
- Attorneys
- Either side may represent themselves or hire an attorney.
- Filing fee
- $70, plus $15 per party if the court serves the claim
- Appeals
- Appeals go to the Superior Court within 30 days: a plaintiff may appeal on questions of law only, while a defendant may appeal on law or fact and may ask for a jury trial.
Who you sue
Maine's reach and apply statute lets an injured person go after the at-fault driver's liability insurer only after winning a final judgment against the insured driver, and not until 20 days after that judgment, so the driver is the defendant in the first case (24-A M.R.S. § 2904).
