Wyoming small claims court for diminished value claims

In Wyoming, small claims cases are heard in Circuit Court (small claims), which handles claims up to $6,000. If an insurer will not pay a diminished value claim and the amount is within the limit, this is where an owner can sue the at-fault driver. You bring the evidence, and the judge decides.

Claim limit
$6,000. The small claims procedure applies where the amount claimed, not counting costs, does not exceed $6,000. The claimant signs an affidavit stating that payment was demanded and refused. Circuit courts also hear regular civil cases up to $50,000 under the ordinary rules. Wyo. Stat. § 1-21-201.
Where to file

Attorneys
Parties may appear with or without an attorney, but if one side appears with an attorney the other is entitled to a continuance to get one (Wyo. Stat. § 1-21-202(b)).
Filing fee
$10, plus the cost of serving the defendant
Appeals
A small claims judgment may be appealed to the district court under the Wyoming Rules of Appellate Procedure, only on questions of law and not for a review of the sufficiency of the evidence (Rule 7, Rules and Forms Governing Small Claims Cases).

Who you sue

Ask the Circuit Court (small claims) clerk how to name the defendant. In most states that is the at-fault driver, not the insurance company.
