Nevada small claims court for diminished value claims
In Nevada, small claims cases are heard in Justice Court (small claims), which handles claims up to $10,000. If an insurer will not pay a diminished value claim and the amount is within the limit, this is where an owner can sue the at-fault driver. You bring the evidence, and the judge decides.

- Where to file
- File in the justice court township where the defendant lives, does business or works, or, for damage to property, the township where the damage happened.
- Attorneys
- Attorneys are allowed but not required, and no attorney's fees are awarded to either side in a small claims case (NRS 73.040).
- Filing fee
- Set by the court and often by county. Check the court’s fee schedule before you file.
- Appeals
- Either party may appeal to the district court by filing a notice of appeal within 7 calendar days from service of the judgment and posting an appeal bond (JCRCP 98-100).
Who you sue
Ask the Justice Court (small claims) clerk how to name the defendant. In most states that is the at-fault driver, not the insurance company.
