Nevada diminished value claims

Nevada has no statute or clear appellate ruling on diminished value after repair. Owners commonly seek it from the at-fault driver, and the Nevada Supreme Court has let owners prove a vehicle's before-and-after value with their own testimony and Kelley Blue Book, but recovery is not guaranteed. Claims against your own insurer depend on the policy. Lawsuits for vehicle damage must be filed within three years.

Dugan v. Gotsopoulos (2001) held a trial court wrongly barred an owner from testifying to her car's value before and after a crash, and from using Kelley Blue Book, and allowed loss-of-use damages even without renting a car. It did not decide whether value lost after a proper repair is recoverable. No controlling Nevada decision on that question was found.

No Nevada decision was found requiring an insurer to pay diminished value under a collision policy. Nevada's claim-handling regulation requires an insurer that elects to repair to restore the vehicle to its pre-loss condition, but it does not mention diminished value.

An owner may testify to her vehicle's value without an expert; Kelley Blue Book is admissible under NRS 51.245; loss-of-use damages may be recovered even if no substitute car was rented. The owner in this case never repaired the car.

  • NRS 11.190(3)(c); 11.190(1)(b): Periods of limitation

    Three years for taking, detaining, or injuring personal property; six years for actions on a written contract.

  • NRS 485.185: Required motor vehicle liability insurance

    Owners must carry at least $25,000 per person and $50,000 per crash for bodily injury and $20,000 for property damage.

  • NRS 41.141: Comparative negligence

    A plaintiff's negligence does not bar recovery for injury to property if it is not greater than the defendants' negligence; damages are reduced accordingly.

  • NAC 686A.680(8): Standards applicable to insurers under automobile policies

    When an insurer elects to repair a vehicle, it must restore it to its condition before the loss at no extra cost to the claimant beyond policy terms, within a reasonable time. The rule does not mention diminished value.

Deadlines and minimum coverage

Time limit for a property-damage lawsuit
3 years (NRS 11.190(3)(c)). Property damage. Claims on a written insurance policy are generally six years (NRS 11.190(1)(b)), but policies often contain shorter suit-limitation clauses.
Minimum liability insurance
$25,000 per person / $50,000 per accident bodily injury; $20,000 property damage. The at-fault driver’s property-damage limit can cap what their insurer pays.
